This terms of services govern all products and services provided by OGVHOST LIMITED, and the following are the terms and conditions:
Parties and Definitions - The definitions of the parties referred to in this agreement are as follows:
OGVHOST LIMITED is the owner and service provider of the website OGVHOST.com (referred to as "OGVHOST" or "this site"). In this agreement, the websites or services mentioned, including various data transfer services, hosting services, or website hosting services, are collectively referred to as "websites" or "services."
You, the OGVHOST LIMITED customer - As a user of our services or a customer of our website services, this agreement may use the second person pronoun interchangeably.
Please read the following terms and conditions. By successfully purchasing OGVHOST LIMITED services, you indicate your agreement and compliance with all the terms and conditions of this agreement ("Agreement"). You should print or otherwise save this agreement as a reference for the future. If you do not agree with all the terms and conditions of this agreement, do not purchase OGVHOST LIMITED products and services. OGVHOST LIMITED only provides services to you after you agree to these terms of service. Any action of using services provided by OGVHOST LIMITED is deemed as your acknowledgment and agreement to the following terms of service.
1. Service 1.1. Before you purchase OGVHOST LIMITED services, you can see a range of packages we offer. You can choose from the listed services. All services you select are subject to this clause. After you order the service, we consider that you accept these terms of use, and OGVHOST LIMITED will send a service order confirmation email. OGVHOST LIMITED reserves the right to refuse to provide any service to you for any reason. Despite our normal operating time guarantee, OGVHOST LIMITED also has the right to interrupt services for routine maintenance during emergencies. You can order additional services at any time. All additional services are considered "Services" as mentioned below. All services provided are subject to all the terms and conditions of this Agreement.
2. User Agreement Revisions 2.1. This Agreement contains the complete terms and conditions applicable to your purchase of OGVHOST LIMITED services and usage conditions (defined below). OGVHOST LIMITED may modify the terms of this Agreement at any time, including fees (defined below), and OGVHOST LIMITED is obligated to inform users of the updates, including but not limited to email notifications, website notifications, and social media notifications.
2.2. We may, at any time, modify this Agreement. You agree that we have the right to do so unilaterally. The updated version will replace any previous versions immediately upon publication, unless the revised version is consistent with the previous version, in which case the previous version will no longer be legally effective. Any third-party modified versions of this Agreement are deemed invalid.
2.3. Waiver - You are responsible for regularly reviewing this Agreement for changes. You have the right to review this revised version at any time. AkileCloud bears no responsibility due to your own negligence in reviewing the changes to this Agreement.
3. Agreement and Cancellation Policy Period 3.1. The initial term begins upon confirmation of your order or service and receipt of legitimate funds. The length of this term is determined by your selection and should be specified when you order our services. This Agreement cannot be terminated during your initial term unless OGVHOST LIMITED defaults.
3.2. OGVHOST LIMITED may also terminate this Agreement ("Termination Without Cause") at any time and for any reason, and in such a case, OGVHOST LIMITED will provide you with written notice.
3.3. If OGVHOST LIMITED cancels this Agreement in accordance with any terms outlined in this Agreement, without termination under Section 3.2, no refund will be given to you. If you need to terminate the service, you are obliged to cancel your subscription before the prepaid service becomes effective. In the case of termination initiated by OGVHOST LIMITED, all prepaid fees will be forfeited and will not be refunded. This means that the termination of this Agreement does not relieve you of the obligation to pay any fees.
3.4. Additionally, OGVHOST LIMITED reserves the right to terminate any part of this Agreement at any time. OGVHOST LIMITED may terminate your service in the following cases: (a) Violation of the acceptable use policy as described; (b) Infringement or violation of any third party's intellectual property or privacy rights or copyrights; (c) Non-compliance with any applicable laws, regulations, or ordinances; (d) Upload, post, or disseminate any images, text, graphics, code, or videos that OGVHOST LIMITED deems illegal or high risk. OGVHOST LIMITED has the discretion, and the purpose of any content in this Agreement is that OGVHOST LIMITED has no responsibility or obligation to monitor or review your content, or any content uploaded or posted by your users at any time. You are still responsible for your content and any liability arising from it.
4. Account Settings 4.1. When registering your account, you will be required to provide a login account (email) and password. You are solely responsible for maintaining the confidentiality of your username and password and the confidentiality of all activities using these credentials. You agree to notify us immediately of any unauthorized access to or use of your account or any other security breaches.
4.2. You must provide us with a primary email address and ensure its availability. All notifications and communication between us will be sent to the email address you provide, so you need to keep this address accessible. Please ensure that our domain OGVHOST.com and other email addresses we inform you of are not included in any spam blocking list used by you or your email provider.
4.3. Providing any type of incorrect or inaccurate contact information, including false/fraudulent information, may result in the termination of your account.
4.4. OGVHOST LIMITED has the right to refuse to provide services and immediately terminate your access to OGVHOST LIMITED accounts in the following circumstances: (a) Failure to meet the conditions of OGVHOST LIMITED providing services; (b) Failure to fulfill a contract at OGVHOST LIMITED related businesses or OGVHOST LIMITED partners; (c) Violation of relevant terms and conditions at OGVHOST LIMITED related businesses or OGVHOST LIMITED partners; (d) Based on existing data, we believe that you may refuse to fulfill the contract or violate our terms or conditions.

The specific rights and responsibilities are subject to the actual agreement text. It is recommended that you carefully read and understand the complete terms of services before using OGVHOST LIMITED services.
5. Intellectual Property 5.1. Between you and OGVHOST LIMITED, OGVHOST LIMITED declares that it does not own the rights or content (including but not limited to text, software, music, sound, audiovisual works, movies, images, animations, videos, and graphics, collectively referred to as "your content") that you provide for use in your services and/or products. By using OGVHOST LIMITED products and/or services, you hereby grant OGVHOST LIMITED a non-exclusive, worldwide, royalty-free license to use your content, reproduce, create derivative works, display, and perform it via the Internet.
5.2. This Agreement does not grant permission to use OGVHOST LIMITED service logos or any other trade emblems. Any use of OGVHOST LIMITED service logos or any other trade emblems without prior written consent from OGVHOST LIMITED is strictly prohibited.
5.3. You acknowledge that even nominal damages may require substantial legal expenses, travel costs, and other amounts. You agree that you will pay all such fees and costs.
6. Content and Acceptable Use Policy 6.1. You agree to comply with OGVHOST LIMITED's Acceptable Use Policy, which OGVHOST LIMITED may modify on the website and is subject to change at any time. OGVHOST LIMITED is obligated to inform users of updates to the Acceptable Use Policy, including but not limited to email notifications, website notifications, and social media notifications. You agree to regularly visit the OGVHOST LIMITED website and review the latest Acceptable Use Policy. Continuing to use OGVHOST LIMITED services after any changes to the Acceptable Use Policy constitutes your acceptance of the new Acceptable Use Policy and is binding on you. If a user's behavior violates the Terms of Service or the Acceptable Use Policy, OGVHOST LIMITED has the right to suspend the user's access to the service at any time.
6.2. OGVHOST LIMITED will not actively monitor the content used by end-users on OGVHOST LIMITED services, although OGVHOST LIMITED may, at its discretion, monitor the services used by customers on the OGVHOST LIMITED network through technical means and disclose any necessary information about your account in cases required by law, regulations, or government organizations. OGVHOST LIMITED will investigate complaints of infringement of third-party rights or violations of the Acceptable Use Policy. OGVHOST LIMITED will attempt to minimize abuse of OGVHOST LIMITED services. OGVHOST LIMITED reserves the right to cooperate with law enforcement agencies and retains the power to notify such agencies if law enforcement agencies suspect any activities violating the laws, regulations, and policies of your jurisdiction. All terms contained in this section are for the benefit of third parties, but no third party is entitled to enforce any terms of this Agreement.
6.3. You must agree that OGVHOST LIMITED will not bear any responsibility for any actions by you or your end-users that violate the Acceptable Use Policy and the laws, regulations, and policies of your jurisdiction, including the Digital Millennium Copyright Act.
6.4. OGVHOST LIMITED may, at its discretion, terminate your access to the service and terminate this Agreement. This may occur when you or your end-users, downstream customers violate the Terms of Service and the Acceptable Use Policy.
6.5. OGVHOST LIMITED takes the issue of child pornography very seriously, and the use of our services by minors can pose potential harm, which should be strictly prohibited. However, their guardians may authorize limited use of OGVHOST LIMITED services by minors. Any content that may be considered child pornography will be deleted and access to it will be prohibited. This applies to OGVHOST LIMITED's cloud hosting and hosting services. Any customer hosted or accessing child pornography through OGVHOST LIMITED services will be immediately terminated and reported to local law enforcement agencies. You agree to cooperate with OGVHOST LIMITED in preventing access to child pornography content, and any content that solicits, entices, or induces sexual activity or lewd conduct with minors is strictly prohibited and will be treated as the same issue as child pornography. OGVHOST LIMITED reserves the right to sue customers who host or access child pornography content on the OGVHOST LIMITED website.
6.6. If you suspect that child pornography content is hosted on the OGVHOST LIMITED network, we encourage you to report it immediately to OGVHOST LIMITED's abuse complaints email at [email protected] or via the abuse complaints department in the customer center, and include file names or URLs (or other locations), victim (if known), date of birth, date of production, and any information about suspicious images (multiple) and other information. Alternatively, you can use the CyberTipline to report suspected child pornography products, and content related to child pornography that is not hosted by OGVHOST LIMITED should be reported directly to law enforcement agencies or the website: https://www.asacp.org/index.php?content=report.
7.2. OGVHOST LIMITED will post modified policies on the website and reserves the right to modify the anti-spam policy at any time. You agree to regularly visit the OGVHOST LIMITED website and review the latest anti-spam policy. Continuing to use OGVHOST LIMITED services after any changes to the anti-spam policy constitutes your acceptance of the new anti-spam policy and is binding on you. If the user's behavior violates the Terms of Service or the anti-spam policy, OGVHOST LIMITED has the right to suspend the user's access to the service at any time.
8. Payment 8.1. The service fees cover the entire service period with OGVHOST LIMITED and are subject to this agreement. Unless your service is terminated, OGVHOST LIMITED will automatically remove your service after your payment cycle expires, and this process is irreversible.
8.2. Unless specifically negotiated and agreed upon in writing between you and us, installation fees and recurring payment fees for the selected services must be paid together as initial charges at the time of online ordering. All setup/installation fees and special configuration fees are non-refundable. Service fees must be paid in advance, and in the absence of timely payment for service fees, your service may be temporarily suspended or deleted.
8.3. At registration, you must select a payment method, and OGVHOST LIMITED reserves the right to enter into agreements with third parties to process all payment requests. Such third parties may impose additional terms and conditions to manage payment processing. If you fail to pay the service fees due in a timely manner, OGVHOST LIMITED reserves the right to charge a certain late fee within the legal limits.
8.4. You agree to pay any taxes incurred as a result of using this service, including income tax, value-added tax, or sales tax. OGVHOST LIMITED is not responsible for any fees incurred by you through the use of this service, including bank checks, credit cards, insufficient funds, and any fees incurred between you and your financial institution. OGVHOST LIMITED shall receive full payment, and if any additional charges arise due to taxes, exchange rate differences, bank charges, transfer fees, etc., you are responsible for covering those costs.
8.5. You also agree to pay any attorney's fees, collection fees, and other charges incurred by OGVHOST LIMITED. Additionally, OGVHOST LIMITED will not refund any installation fees, special configuration fees, or remaining prepaid fees.
8.6. Once OGVHOST LIMITED begins providing services, we will no longer entertain any refund requests, and refunds will not be issued for purchasing the wrong region.
8.7. Coupons and promo codes - OGVHOST LIMITED may offer coupons and promo codes, which may only apply to first-time customers. Therefore, these discounts may not be applicable if you have already subscribed to OGVHOST LIMITED services. These coupons and promo codes may not apply when you upgrade your product. Any accounts attempting to abuse coupons and promo codes may be suspended or deleted.
9. Backup Measures & Data Loss 9.1. You agree that the security of the data you use is your responsibility. OGVHOST LIMITED will take necessary measures to protect the security of your data. However, this still requires you to take security measures for your data. We cannot guarantee complete recovery of your service in the event of data loss. Therefore, we strongly recommend that you establish your own daily backup procedures to ensure the safety of your data.
9.2. If you wish for OGVHOST LIMITED to provide daily backup services, this is not a service provided by this Agreement. Please contact us, and we offer various backup services beyond routine services. You can choose one of them as a solution, and we will provide all services through a separate written agreement.
10. Resource Usage & Security 10.1. OGVHOST LIMITED does not impose hard limits on system resources and hardware devices available to each account. We do not deactivate user accounts proactively unless the resources/facilities used by the user significantly exceed acceptable usage levels or maintaining the user's usage severely affects the experience of other customers, and similar situations.
10.2. Reverse engineering, decompiling, or disassembling the website and/or derived works of materials is not permitted unless expressly allowed by law. You agree not to use any automatic devices or manual processes to monitor or replicate the website or materials, and you will not use any devices, software, computer code, or viruses to interfere with or attempt to interfere with or disrupt our services and website.
10.3. Security - Any violation of the security of the website and/or services is strictly prohibited and may result in criminal and civil liability. You agree not to engage in any activities that may violate or attempt to alter or manipulate hardware and software, jeopardize servers, or any other unauthorized use. You are prohibited from engaging in:
